IANNDEY

This Privacy Policy is intended to provide you with a clear view of how we use the personal data that our customers provide us, our efforts to protect it, the options you have to control your personal data and protect your privacy. It also describes what kind of personal data we collect about you when you visit our website and how we use your personal data to make our products and services and your experience better and better.

In compliance with the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations (hereinafter, the "Data Law"), as well as in accordance with the Guidelines of the Privacy Policy published in the Official Gazette of the Federation on January 17, 2013, the following is reported:

Identity and address of the responsible person.

Mario Ivan Gallegos Laredo (hereinafter “IANNDEY”), with address at Torre Trajana 137, Alamedas de España, 37204, in the city of León, Guanajuato, Mexico, in its capacity as Responsible, issues this privacy policy to establish the terms and conditions under which it will treat your personal data in compliance with the Federal Law on Protection of Personal Data in Possession of Individuals (hereinafter “LFPDPPP”) and its Regulations.

Personal data collected by IANNDEY.

To accomplish the purposes described in this privacy policy, IANNDEY will collect your personal identification data; image data; contact information; clothing, design and/or pattern data; electronic data; and property and/or financial information.

Sensitive personal data, which are, in general, all those that affect the most intimate sphere of the Holder, or whose improper use may give rise to discrimination or entail a serious risk for it. In particular, those that may reveal aspects such as racial or ethnic origin, past and present health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions, sexual preference will be considered sensitive.

IANNDEY may collect Personal Data from minors and people who are in a state of interdiction or disability, obtaining prior written consent from their parents or guardian, maintaining security measures during the process in accordance with the principles of the LFPDPPP.

Personal data may be collected personally, by telephone, website or digital platforms, email and/or parcel service, social networks or instant messaging service. When the Owner provides IANNDEY with their personal or third-party data, they acknowledge that they are providing consent for IANNDEY to process them for the purpose that they designate, and also acknowledge that these data are correct.



Purposes of the processing of personal data.



Primary purposes.

IANNDEY will collect your personal data for the following purposes and objectives: I) customer prospecting; II) identification, registration, contact and knowledge of the client; III) rectification and modification of information; IV) provide care and follow-up to the sale of the product; V) design, pattern making and clothing; VI) administration of purchases and merchandise returns; VII) collection, refunds and billing; VIII) create and manage your profile for online services and mobile application; IX) delivery of merchandise; X) statistical purposes; XII) provide attention to requests for ARCO rights and claims; XIII) access, control and security within the company; XIV) publication, reproduction, edition and/or fixation of audiovisual material; XV) dissemination of works; XVI) for commercial, advertising and social use.

Secondary purposes.

In order to provide you a better service, IANNDEY will process your Personal Data for the following non-essential purposes: I) marketing and market research; II) commercial advertising of products, services and promotions; III) invitations to participate in events, recreational or altruistic activities; IV) carry out service and/or product surveys and feedback.

If you do not want your personal data to be used for the secondary purposes described above, you must express your refusal to such treatment. To facilitate the exercise of this right, we put at your disposal the format called “ARCO Rights Request Form for Clients” that you can download here or request it by email at contacto@ianndey.com.

Video surveillance system.

IANNDEY is generally aware that any person visiting its offices may be video recorded by the security cameras located in its facilities. The recordings will be used for the security of IANNDEY, and will be kept for a maximum period of 7 (seven) calendar days, and will subsequently be automatically deleted.

Transfer of personal data.

IANNDEY will not transfer personal data without the prior and/or written consent of its Holder, except in the cases mentioned in article 37 of the LFPDPPP, and will only send them in order to accomplish with its contractual obligations. Responsible or Third Party providers are obliged to maintain the confidentiality of personal data and to observe this privacy policy.

IANNDEY as responsible may send personal data to:

  • Mexican authorities;
  • Related companies;
  • Internal and/or external audit suppliers;

IANNDEY undertakes to transfer only that information that is absolutely and strictly necessary, and when sharing personal data with Third Parties, it will use commercially reasonable efforts to ensure that they take the necessary measures to protect the confidentiality and security of personal data. IANNDEY will require that said Third Parties comply with the LFPDPPP, as well as with IANNDEY's policies and privacy notice, and will prohibit the use of personal data for a purpose other than that which has been agreed with IANNDEY through the corresponding contracts and agreements.

Exercise of ARCO rights.

At any time, directly or through your legal representative, you can request IANNDEY to exercise your rights of Access, Rectification, Cancellation or Opposition (ARCO rights) of the personal data subject to treatment. To facilitate the exercise of these rights, we put at your disposal the format called "ARCO Rights Request Form for Clients" that you can download here or request it by email at contacto@ianndey.com.

Procedure to exercise ARCO rights.

  • Once you have downloaded, printed, filled out and autographedly signed the “ARCO Rights Application Form for Clients” format, you must present it in original at the IANNDEY office, located at Torre Trajana 137, Alamedas de España, 37204, in the city of Leon, Guanajuato, Mexico.

    We also make available to you the option of sending us the aforementioned format after digitizing it to the email address contacto@ianndey.com.
  • It is essential that you accompany the format described in the previous point, a simple copy or digitization of a current official identification document (INE, Passport or immigration form) and any other document that facilitates the location of personal data.

    In the event that the request is submitted through your legal representative, you must include a power of attorney granted by you with the acceptance signature of the attorney, in the presence of two witnesses, and must include the name, signature, address and photocopy of the official identification of each of the signatories.
  • In the event that the information provided in your application is insufficient, erroneous, or does not include the corresponding accreditation documents, IANNDEY may request that you correct the omissions in question within five business days following the date of receipt. You or your legal representative will have ten business days to correct the omissions, counted from the day after you received the notification. If you do not respond, your request will be deemed not submitted.
  • Only for the exercise of ARCO rights, in the response we will indicate the modality or means in which you can obtain the reproduction of the personal data that you have requested.

We inform you that the Public Relations department will process your requests for the exercise of ARCO rights, whom you can contact through the email account contacto@ianndey.com.

We remind you that you can also report privacy incidents, as well as formulate disagreements, complaints or claims related to the processing of your personal data by sending them to the email address contacto@ianndey.com.

Limitation of use or disclosure of information.

You may at any time limit the use or disclosure of your personal data by requesting your ARCO rights to IANNDEY via email addressed to contacto@ianndey.com. Likewise, you can register in the Public Registry to Avoid Publicity of the Federal Consumer Protection Agency. Use of cookies.

IANNDEY informs that its website uses cookies to identify trends, remind users, customize the site according to their preferences and for advertising purposes. These cookies do not collect any information that allows the user to be identified, they are used only in order to help improve the functionality of your website and to have a better understanding of the interests of your visitors.
